Best Practices for Reps: Commission Collection Services

MRCS assists manufacturers’ representatives in collecting unpaid sales commissions. MRCS has been in operation for over 30 years. While 60% of sales commission claims placed with MRCS are resolved amicably, MRCS will litigate in either state or federal court when necessary. Thirty-three (33) states have passed punitive damage statutes which protect manufacturers’ representatives’ rights and MRCS will utilize these statutes when appropriate.

One of the most frequently asked questions is "How far back can we go to collect sales commissions?" The answer to this question depends upon the statute of limitation in the individual state. Each state has a different statutory period which also varies with a written contract. In general, the statutory period is three years with no contract and up to ten years with a written contract. All sales commission collection claims by MRCS are on a contingency (no collection-no fee) basis.
